Even if your case is dismissed or remanded, sometimes the charge can still show on your record. That’s because the arrest for the charge may show up on a background check, because even if the case has not been dismissed the record of the arrest has not been expunged. However, the Court is required to expunge a misdemeanor where an arrest was made but the charge was dismissed or remanded.
Pursuant to § 99-15-123 (3), Mississippi law requires the Court, upon petition, to expunge the record in which an arrest was made, the individual was released and the case was dismissed or the charges were dropped or there was no disposition of the case or the individual was not formally charged within 12 months of being arrested.
