Mississippi Code Annotated 91-7-149 governs the filing of probate of claims. A creditor must file a sworn affidavit regarding the claim and it must be filed with ninety (90) days within the notice to creditors period. When making a proof of claim, it is important to follow the statute otherwise you would be in jeopardy of losing your claim and being unable to collect from the Estate. We have experience filing claims and have presented several successful claims in probate.
