In Mississippi, making sure your rights as a heir at law are sometimes not as clear and easy as the law may make it seem. If a person dies without a will, in order to transfer property both real and personal, the Court must determine who are the heirs at law. Under the Mississippi Code 91-1-15 , if your parent is not on your birth certificate and there was no judicial determination that you were the child of this parent (adoption, child support, etc.), then there is a time period which you must come forward to file as an heir at law.
